Welcome to DayByDeals Marketplace. By accessing, registering, listing products, purchasing products, or otherwise using the DayByDeals platform, you agree to be bound by these Marketplace Terms & Conditions.

1. Marketplace Overview

DayByDeals is an online marketplace that connects independent sellers with buyers. DayByDeals provides marketplace technology, payment processing, order management, customer support assistance, and seller administration tools.

Unless expressly stated otherwise, products listed on DayByDeals are sold by independent sellers and not by DayByDeals.

2. User Eligibility

• You must be at least 18 years old.
• You must provide accurate registration information.
• You are responsible for maintaining account security.
• You agree to comply with all applicable laws and regulations.

3. Buyer Responsibilities

• Provide accurate delivery information.
• Review product descriptions before purchasing.
• Pay using approved payment methods.
• Communicate respectfully with sellers and support staff.
• Refrain from fraudulent or abusive activity.

4. Seller Responsibilities

• Provide accurate product information.
• Maintain sufficient stock levels.
• Dispatch orders within stated handling times.
• Comply with South African laws and regulations.
• Respond promptly to customer enquiries.
• Honour advertised pricing.
• Maintain accurate business information.

Sellers remain solely responsible for their products, warranties, descriptions, images, quality, safety, legality, pricing, stock availability, and fulfilment.

5. Product Listing Requirements

All listings must:

• Be accurate and truthful.
• Use genuine product images.
• Clearly identify compatible or non-original products.
• Contain correct specifications.
• Display prices in South African Rand (ZAR).
• Comply with applicable advertising regulations.

Listings may not contain:

• Misleading information.
• False claims.
• Counterfeit products.
• Copyright or trademark infringements.
• Offensive content.
• Prohibited products.

6. Prohibited Products

The following products may not be listed or sold:

• Illegal goods.
• Counterfeit products.
• Stolen goods.
• Weapons and ammunition.
• Explosives.
• Illegal drugs or narcotics.
• Prescription medicines.
• Tobacco products.
• Adult content.
• Hazardous materials.
• Products that infringe intellectual property rights.

DayByDeals reserves the right to remove prohibited listings without notice.

7. Orders & Payments

• Orders are subject to payment verification.
• Payments must be made through approved payment methods.
• DayByDeals may cancel suspicious or fraudulent transactions.
• Additional verification may be required before processing orders.

8. Seller Payouts

Seller payouts are processed according to the DayByDeals Seller Agreement and applicable marketplace fee structure.

Payouts may be delayed if:

• An order is disputed.
• A chargeback is received.
• Fraud investigations are ongoing.
• Required verification documents are outstanding.

9. Delivery

Delivery estimates are provided in good faith but are not guaranteed.

DayByDeals and its sellers shall not be liable for delays caused by:

• Courier disruptions.
• Public holidays.
• Weather events.
• Strikes.
• Force majeure events.

10. Returns & Refunds

Returns and refunds are governed by applicable South African consumer protection laws and the DayByDeals Returns Policy.

Buyers may be required to provide proof of purchase, photographs, product details, or return tracking information before a claim is processed.

11. Reviews & Ratings

Users may submit reviews based on genuine purchasing experiences.

DayByDeals reserves the right to remove reviews that are:

• False or misleading.
• Fraudulent.
• Abusive or offensive.
• Defamatory.
• Promotional or spam-related.

12. Intellectual Property

All DayByDeals branding, logos, software, website content, and marketplace technology remain the property of DayByDeals or its licensors.

Users may not copy, reproduce, distribute, or exploit marketplace content without prior written permission.

13. Privacy & POPIA Compliance

Personal information is collected and processed in accordance with the Protection of Personal Information Act (POPIA).

Information may be used to:

• Process orders.
• Verify identities.
• Prevent fraud.
• Improve marketplace services.
• Comply with legal obligations.

14. Account Suspension

DayByDeals reserves the right to suspend or terminate accounts that:

• Provide false information.
• Commit fraud.
• Abuse the platform.
• Sell prohibited products.
• Repeatedly violate marketplace policies.
• Engage in unlawful activity.

15. Limitation of Liability

To the maximum extent permitted by law, DayByDeals shall not be liable for:

• Indirect losses.
• Consequential damages.
• Loss of profits.
• Business interruption.
• Seller conduct.
• Product defects caused by third-party sellers.

16. Indemnity

Users agree to indemnify and hold harmless DayByDeals, its directors, employees, agents, affiliates, and partners against claims arising from:

• Breach of these Terms.
• Fraudulent conduct.
• Intellectual property infringement.
• Seller misconduct.
• Violation of applicable laws.

17. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.

18. Changes to These Terms

DayByDeals may amend these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of the updated Terms.
