Marketplace Seller Standards

These standards explain the responsibilities expected of marketplace sellers offering products through DayByDeals, including requirements relating to listings, pricing, stock, fulfilment, customer service, returns and marketplace conduct.

Core Seller Responsibility

Marketplace sellers are responsible for the products they offer, the accuracy of their listings and fulfilling their obligations in accordance with applicable law, DayByDeals Marketplace Terms and applicable marketplace policies.

1. Overview

DayByDeals operates as a South African online marketplace through which participating marketplace sellers may offer products to customers.

These Marketplace Seller Standards establish general expectations for sellers using the DayByDeals marketplace. They should be read together with the DayByDeals Marketplace Terms and other applicable marketplace policies.

Sellers remain responsible for understanding and complying with laws, regulations and other requirements applicable to their products and business activities.

2. Seller Information

Sellers must provide accurate and current information reasonably required to operate their marketplace account.

Depending on the seller and circumstances, this may include:

  • Business or trading name.
  • Relevant registration information.
  • Contact information.
  • Operational or fulfilment information.
  • Payment or settlement information where required.
  • Other information reasonably required for marketplace administration or compliance.

Sellers should update relevant account information when material changes occur.

3. Legal & Regulatory Compliance

Sellers are responsible for ensuring that their products, listings and marketplace activities comply with applicable laws and regulatory requirements.

A seller must not use DayByDeals to knowingly offer unlawful products or engage in unlawful marketplace activity.

The ability to create or submit a listing does not by itself establish that a product is lawful or permitted for sale.

4. Product Listing Standards

Sellers are responsible for ensuring that product listings accurately describe the products being offered.

Listings should accurately identify, where relevant:

  • Product name and brand.
  • Model or part number.
  • Product condition.
  • Colour, size, capacity or quantity.
  • Important specifications.
  • Compatibility information.
  • Included accessories.
  • Warranty information where applicable.
  • Other material product information.

Sellers must not intentionally omit or misrepresent information where doing so would create a materially misleading impression of the product.

5. Product Authenticity

Sellers must not knowingly list counterfeit products or falsely describe a product as genuine, original, authorised or manufacturer-approved when that description is not accurate.

Sellers should be able to provide reasonable supporting information relating to product sourcing or authenticity where such information is reasonably required to investigate a marketplace concern.

Brand names and trademarks must not be used in a way that intentionally misleads customers regarding the manufacturer, origin or status of a product.

6. Stock & Availability

Sellers are responsible for maintaining reasonably accurate availability information for products they offer through DayByDeals.

Sellers should avoid accepting orders for products they know they cannot reasonably fulfil.

Where a product becomes unavailable after an order has been placed, the seller should cooperate with DayByDeals so that the customer can be informed and appropriate next steps can be taken.

7. Pricing

Sellers are responsible for the prices they submit or maintain for their marketplace listings, subject to applicable DayByDeals marketplace arrangements.

Pricing should be accurate and should not intentionally mislead customers regarding the actual selling price, promotion or claimed saving.

Where a material pricing error occurs, the seller should promptly cooperate with DayByDeals in reviewing the affected listing or order.

8. Order Fulfilment

Sellers are responsible for fulfilling accepted marketplace orders in accordance with the applicable order details and marketplace requirements.

Sellers should:

  • Review incoming orders promptly.
  • Supply the correct product and quantity.
  • Use suitable packaging for the product.
  • Provide required fulfilment information where applicable.
  • Avoid marking an order as dispatched before it has actually been dispatched.
  • Communicate material fulfilment problems promptly.

9. Delivery & Dispatch

Where a seller is responsible for dispatch or fulfilment, the seller should process orders in a manner consistent with the delivery information presented to the customer.

Sellers must not intentionally provide false dispatch, courier or tracking information.

If an order cannot reasonably meet the applicable delivery expectation, the seller should notify or cooperate with DayByDeals as soon as reasonably possible.

10. Order Cancellations

Sellers should cooperate with legitimate cancellation requests where cancellation remains operationally possible and where cancellation is required or permitted under applicable marketplace policies or law.

Sellers should not dispatch an order after receiving confirmation that the order has been cancelled.

11. Returns & Refund Cooperation

Sellers must reasonably cooperate with DayByDeals when a customer submits an eligible return, refund or product complaint relating to a seller's order.

Where assessment of a returned product is necessary, sellers should provide relevant information and complete applicable marketplace steps without unreasonable obstruction.

Once a customer refund has been approved, DayByDeals processes the approved refund within 7 days. Additional processing time by the customer's bank, card issuer or payment service provider may apply.

12. Faulty, Damaged or Incorrect Products

Sellers should cooperate with the investigation and resolution of claims involving products alleged to be faulty, defective, damaged, incorrect or materially different from the relevant listing.

Depending on the circumstances, this may involve providing product information, arranging assessment, assisting with return processing or participating in an appropriate remedy.

13. Customer Service & Communication

Seller communications connected with marketplace orders should be professional, accurate and relevant to the transaction.

Sellers must not use customer communication channels to:

  • Harass or threaten customers.
  • Provide deliberately misleading order information.
  • Request unnecessary confidential banking credentials.
  • Request a customer's PIN, password or one-time PIN (OTP).
  • Attempt to improperly avoid applicable marketplace processes.

14. Customer Information & Privacy

Customer information made available to a seller in connection with an order should only be used for legitimate purposes connected with fulfilling the transaction, providing applicable customer service or meeting lawful obligations.

Sellers are responsible for handling personal information in accordance with applicable privacy and data-protection requirements.

Customer information must not be improperly sold, disclosed, harvested or used for unrelated purposes.

15. Intellectual Property

Sellers are responsible for ensuring that product listings, images, descriptions, trademarks and other content they submit do not unlawfully infringe third-party intellectual property rights.

16. Prohibited Seller Conduct

Sellers must not knowingly engage in conduct intended to deceive customers or undermine the integrity of the DayByDeals marketplace.

Examples may include:

  • Creating materially misleading product listings.
  • Knowingly offering counterfeit or unlawful products.
  • Providing false tracking or fulfilment information.
  • Manipulating orders or transactions dishonestly.
  • Misrepresenting seller identity or business information.
  • Misusing customer personal information.
  • Using false claims of brand authorisation or endorsement.
  • Attempting to circumvent applicable marketplace controls improperly.
  • Submitting fraudulent information or documentation.

17. Prohibited & Restricted Products

Some product categories may not be permitted on DayByDeals, while other categories may be subject to additional requirements or restrictions.

Sellers are responsible for checking applicable marketplace requirements before listing a product.

Important

Publication of a listing does not remove the seller's responsibility to ensure that the product can lawfully be offered, advertised, sold and delivered.

18. Customer Complaints & Disputes

Where a complaint relates to a marketplace seller, DayByDeals may communicate with the relevant seller and request information reasonably necessary to review the matter.

Sellers should cooperate with legitimate marketplace investigations and provide relevant information within reasonable operational requirements.

19. Marketplace Review

DayByDeals may review seller activity where there is a marketplace, customer, legal, product, fulfilment, intellectual property or policy concern.

DayByDeals may request information reasonably necessary to understand the circumstances of a listing, order, complaint or seller account.

The existence of a review does not by itself establish that the seller has breached a marketplace requirement.

20. Marketplace Action

Where reasonably appropriate and subject to applicable marketplace terms, DayByDeals may take action in response to marketplace or seller concerns.

Depending on the circumstances, this may include:

  • Requesting correction of listing information.
  • Requesting additional seller information.
  • Removing or limiting a product listing.
  • Restricting particular listing activity.
  • Temporarily restricting marketplace functionality.
  • Reviewing affected customer orders.
  • Taking action available under applicable Marketplace Terms.

The appropriate action will depend on the nature, seriousness and circumstances of the matter.

21. Account Restriction, Suspension or Termination

A seller's marketplace access may be restricted, suspended or terminated where permitted under applicable Marketplace Terms, including where serious or repeated marketplace concerns arise.

Relevant circumstances may include serious policy breaches, unlawful activity, fraudulent conduct, repeated fulfilment failures or other material breaches of applicable seller obligations.

Any outstanding customer matters may continue to require appropriate cooperation even where seller marketplace access has been restricted or ended.

22. Keeping Seller Information Current

Sellers should keep their marketplace information, product listings, stock information, pricing and relevant business information reasonably current.

Sellers should also review applicable DayByDeals policies when notified of material marketplace changes.

23. Marketplace Terms

These standards should be read together with the applicable DayByDeals Marketplace Terms & Conditions and other policies that apply to marketplace activity.

24. Seller Support
