Marketplace Notice
DayByDeals is an online marketplace that connects buyers with independent third-party sellers. Sellers are responsible for ensuring that their products, images, trademarks, descriptions, and other content comply with applicable laws and intellectual property rights.
DayByDeals does not claim ownership of seller-submitted content and may investigate, remove, restrict, or disable access to listings where a valid intellectual property complaint has been received.
What Is Intellectual Property?
Intellectual property ("IP") refers to legally protected creations such as trademarks, copyrights, patents, designs, logos, product images, brand names, written content, software, and other proprietary materials.
What Can Be Reported?
Rights holders may submit a complaint regarding:
- Trademark infringement
- Counterfeit products
- Copyright infringement
- Patent infringement
- Unauthorized use of logos or brand names
- Unauthorized use of images or photographs
- Unauthorized copying of product descriptions or content
- Other intellectual property violations
How to Submit a Complaint
If you believe your intellectual property rights have been infringed, please email our compliance team with the required information listed below.
Required Information
- Your full name.
- Your company name (if applicable).
- Your contact email address.
- Your contact telephone number.
- A description of the intellectual property being infringed.
- The URL(s) of the product listing or content being reported.
- Supporting evidence demonstrating ownership or authorization.
- A statement confirming the accuracy of your complaint.
By submitting a complaint, you confirm that you are the intellectual property rights holder or are authorized to act on behalf of the rights holder, and that the information provided is accurate to the best of your knowledge.
Our Review Process
After receiving a complaint, DayByDeals may:
- Review the complaint and supporting documentation.
- Request additional information if necessary.
- Contact the seller or content owner involved.
- Temporarily restrict access to the reported content.
- Remove listings that appear to violate intellectual property rights.
- Take further action in accordance with our marketplace policies.
Seller Response Rights
Sellers may be provided an opportunity to respond to complaints and submit documentation supporting their right to use the disputed content, branding, images, or products.
DayByDeals may review information from both parties before determining whether content should remain available on the platform.
Repeat Infringement Policy
Sellers who repeatedly violate intellectual property rights or marketplace policies may be subject to account restrictions, listing removals, suspension, or permanent removal from the DayByDeals Marketplace.
False or Misleading Complaints
Complaints that contain false, misleading, fraudulent, or inaccurate information may be rejected. DayByDeals reserves the right to request additional verification before taking action.
