Product Authenticity & Listing Standards

Overview

DayByDeals is a South African online marketplace operated by Day By Deals (Pty) Ltd. Products may be offered directly by DayByDeals or by participating independent marketplace sellers.

These standards explain the requirements for product authenticity, listing accuracy and transparent product information on DayByDeals.

Sellers are responsible for ensuring that their products and listings comply with applicable law and relevant marketplace policies.

Product Authenticity

Sellers must have the legal right to offer the products they list. Counterfeit products and goods bearing unauthorised or misleading trademarks are prohibited.

Sellers must not represent a product as genuine, original, officially authorised or manufacturer-approved unless that representation is accurate.

Where reasonably necessary, DayByDeals may request documentation supporting a product's origin or authenticity.

Product Condition

The condition of every product must be described accurately. Sellers must not describe used, refurbished or remanufactured products as new.

Additional product-specific disclosures may be required under applicable law.

Accurate Product Descriptions

Product listings must contain accurate information about the goods being offered.

• Correct product title, brand and model.
• Accurate technical specifications and dimensions.
• Clear product condition and included accessories.
• Accurate colour, size, capacity and compatibility information.
• Relevant safety warnings and usage limitations.
• Accurate warranty information where applicable.
• Disclosure of material defects or restrictions.

Sellers must not use misleading descriptions, omit material information or make unsupported performance claims.

Product Images & Visual Accuracy

Product images must accurately represent the goods offered for sale.

• Use clear photographs of the actual product or an accurate manufacturer representation.
• Do not use images that materially misrepresent the product's condition or included accessories.
• Do not display another brand's packaging as if it were the packaging of the product being sold.
• Clearly distinguish illustrative lifestyle images where necessary.
• Do not use images without the required rights or permissions.

Where a listing contains multiple variants, the selected variant must be represented accurately.

Brand Representation & Compatibility

Sellers must distinguish original branded products from compatible, third-party or remanufactured alternatives.

Brand names may be used to identify genuine products or accurately describe compatibility, where lawful. Such references must not misleadingly imply official affiliation or endorsement.

Sellers must not claim to be an authorised distributor, official reseller or approved brand partner without appropriate supporting authorisation.

Product Identifiers & Specifications

Where applicable, sellers should provide accurate product identifiers, including GTIN, EAN, UPC, manufacturer part number or model number.

Sellers must not assign an identifier belonging to a different product, variant or manufacturer.

If a product has no manufacturer-assigned GTIN, sellers must not invent one.

Product identifiers, specifications and variant information must be consistent across the listing and applicable product data feeds.

Pricing, Availability & Promotions

Sellers must maintain accurate product prices, stock availability and promotional information.

• Prices must match the applicable offer presented at checkout.
• Stock availability must reflect actual fulfilment capability.
• Promotional claims must be accurate and supportable.
• Delivery charges and relevant conditions must be communicated transparently.
• Material listing errors must be corrected promptly.

Sellers must not knowingly advertise unavailable goods in a manner that misleads customers.

Seller Transparency

Products on DayByDeals may be offered directly by DayByDeals or by independent marketplace sellers.

The applicable seller must be identifiable through the relevant product listing or transaction information.

Sellers must provide accurate business information and promptly update material changes.

Customers can contact DayByDeals for assistance with orders placed through the marketplace.

Product Safety & Legal Compliance

Sellers must ensure that products comply with applicable South African safety, labelling and product-specific legal requirements.

Products requiring licences, permits, certification or additional documentation must not be offered without the applicable requirements being met.

Sellers must not list recalled, unlawfully imported or otherwise prohibited goods.

Authenticity Checks & Supporting Evidence

DayByDeals may request supporting information when investigating a product authenticity, ownership or listing accuracy concern.

Depending on the circumstances, relevant evidence may include supplier invoices, purchase records, product photographs, serial numbers or brand authorisation documents.

Sellers must provide accurate information and cooperate with reasonable marketplace verification requests.

DayByDeals may temporarily restrict affected listings while a material concern is being reviewed.

Reporting Suspected Counterfeit or Misleading Products

Customers, sellers and rights holders may report concerns about potentially counterfeit products, misleading listings or unauthorised intellectual-property use.

Reports should include the product URL, relevant order number where applicable, a description of the concern and any supporting evidence.

DayByDeals may request further information to review the report and determine the appropriate response.

Listing Reviews & Enforcement

DayByDeals may review listings and take proportionate action where marketplace requirements are not met.

Depending on the circumstances, this may include:

• Requesting corrections to inaccurate product information.
• Requesting authenticity or ownership evidence.
• Restricting or removing affected listings.
• Restricting access to relevant product categories.
• Suspending or terminating seller access where justified.

Sellers remain responsible for outstanding customer obligations arising from affected orders.

Customer Rights & Remedies

Customers who receive counterfeit, faulty, incorrectly supplied or materially misdescribed goods may contact DayByDeals for assistance.

Available remedies depend on the circumstances and applicable South African consumer law.

Nothing in this policy excludes or limits statutory consumer rights that cannot lawfully be restricted.
