Product Authenticity & Listing Standards
These standards explain the responsibilities of marketplace sellers when listing products on DayByDeals and how customers can report products or listings that may be inaccurate, misleading, unlawful or otherwise inappropriate.
Sellers are responsible for ensuring that their product information is accurate and not misleading.
Products offered through the marketplace must comply with applicable laws and marketplace requirements.
Customers can report suspicious, inaccurate or potentially infringing product listings.
DayByDeals operates as an online marketplace. Products may be offered by participating marketplace sellers. Sellers are responsible for the products they list and for ensuring that their listings comply with applicable law and DayByDeals marketplace requirements.
1. Purpose of These Standards
DayByDeals aims to provide customers with useful and accurate information when browsing products offered through the marketplace.
These standards establish general requirements for product listings submitted or maintained by participating marketplace sellers.
Sellers remain responsible for ensuring that their products, product information and marketplace activities comply with applicable laws, regulations and contractual requirements.
2. Seller Responsibility
Marketplace sellers are responsible for the accuracy, legality and appropriateness of products they offer through DayByDeals.
Sellers should ensure that:
- The product being offered actually exists and is available for sale.
- The seller has the right to offer the product.
- Product information is accurate and not materially misleading.
- The correct brand and manufacturer information is used.
- Product condition is clearly disclosed.
- Images reasonably represent the product being offered.
- Pricing and availability information is kept reasonably current.
- Applicable warranty information is not misrepresented.
- Required safety or regulatory information is provided where applicable.
3. Product Authenticity
Sellers must not knowingly list counterfeit products or misrepresent a product as being manufactured, authorised or endorsed by a brand when that is not true.
Brand names, logos, model numbers and other identifying information should only be used where they accurately describe the product being offered.
DayByDeals does not describe every marketplace product as independently authenticated or individually verified unless such verification has actually taken place.
4. Counterfeit & Misrepresented Products
Sellers must not offer products that unlawfully imitate another brand's products or use another party's intellectual property in a manner that infringes applicable rights.
Listings must not falsely claim that a product is:
- Genuine or original when it is not.
- Manufactured by a particular brand when it is not.
- An authorised product when no such authorisation exists.
- New when the actual condition is used, refurbished or otherwise different.
- Covered by a manufacturer warranty when that is not the case.
5. Product Condition
The condition of a product should be clearly and accurately disclosed in the relevant listing.
Where applicable, sellers should distinguish between products that are new, used, refurbished, open-box, demonstration stock or otherwise materially different from a new retail product.
A seller must not describe a product as new where its actual condition does not reasonably support that description.
6. Product Titles & Descriptions
Product titles and descriptions should help customers understand what they are purchasing.
Listings should accurately identify relevant information such as:
- Brand.
- Product name.
- Model or part number where applicable.
- Colour, size or capacity where relevant.
- Quantity or pack size.
- Important compatibility information.
- Product condition.
- Important included or excluded accessories.
Sellers should not use misleading keywords, unrelated brand names or inaccurate specifications to attract customers to a listing.
7. Product Images
Product images should reasonably represent the product being offered and should not intentionally create a misleading impression about the item.
Sellers are responsible for ensuring that they have appropriate rights or permission to use images submitted with their listings.
Images should not falsely suggest that accessories, quantities or other items are included when they are not.
8. Pricing & Availability
Sellers are responsible for maintaining accurate product pricing and availability information for their listings.
Pricing must not be presented in a manner intended to materially mislead customers regarding the amount payable, a promotion or a claimed saving.
Product availability should be updated when stock circumstances materially change.

Sellers should only associate a listing with a brand where that brand accurately identifies the product.
The use of a manufacturer's or brand owner's name on DayByDeals does not by itself mean that DayByDeals is affiliated with, authorised by or endorsed by that manufacturer or brand owner.
Any specific authorised reseller, distributor or official partnership claim should only be made where it can be substantiated.
10. Compatibility Claims
Where a product is designed for use with another product, device, vehicle, system or brand, compatibility information should be accurate and sufficiently clear for customers to understand the intended application.
A compatibility statement must not falsely suggest that the product was manufactured, approved or endorsed by another brand.
11. Prohibited or Restricted Listings
Certain products may be prohibited from the DayByDeals marketplace or may be subject to additional requirements, restrictions or verification before they may be offered.
Sellers are responsible for determining whether their products can lawfully be offered and delivered in the relevant jurisdiction.
DayByDeals maintains or may maintain additional requirements concerning prohibited and restricted products.
12. Intellectual Property
Sellers are responsible for ensuring that their listings do not unlawfully infringe trademarks, copyrights, designs or other intellectual property rights.
Rights holders or authorised representatives who believe that marketplace content infringes their rights can submit a complaint through the DayByDeals intellectual property complaint process.

Customers who believe a listing may contain inaccurate, misleading or suspicious product information can contact DayByDeals Customer Support.
When reporting a listing, please provide where possible:
- A link to the relevant product.
- The product name.
- The seller name where displayed.
- A description of the concern.
- Relevant photographs or supporting information.
- Your order number if the product has already been purchased.
14. DayByDeals Review & Marketplace Action
Where DayByDeals becomes aware of a listing that may breach marketplace requirements, DayByDeals may review the available information and request additional information from the seller.
Depending on the circumstances and applicable marketplace terms, appropriate action may include:
- Requesting correction of listing information.
- Requesting supporting documentation.
- Temporarily limiting visibility of a listing.
- Removing a listing.
- Restricting the seller's ability to list particular products.
- Taking other action permitted under applicable marketplace terms.
The appropriate action will depend on the circumstances and available information.
15. Customers Who Have Already Purchased
If you have already purchased a product and believe that the product received is materially different from its listing, faulty, damaged, incorrect or otherwise problematic, contact DayByDeals Customer Support.
Depending on the circumstances, the issue may be handled under the applicable returns, warranty, refund or complaint process.
16. Consumer Rights
These marketplace standards are intended to operate consistently with applicable South African law.
Nothing in these standards is intended to exclude, restrict or replace a statutory consumer right or remedy that cannot lawfully be excluded or restricted.
